These Terms of Service ("Terms") govern your access to and use of the website https://diffythemetools.com and the Diffy Theme Tools application and related services (the "Services"), provided by Rainmaker Web Design, LLC doing business as Immersive E-commerce ("we", "us", or "our"). By accessing the Website or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

Diffy is a Shopify application that provides theme diffing, change tracking, file search, and backups for Shopify stores. The Services are made available through the Shopify App Store and are subject to Shopify's own terms in addition to these Terms.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for activity under your account and for maintaining the security of your Shopify store credentials and any access you grant to the app.

3. Fees and billing

Paid plans, free trials, and charges for the app are described on the Shopify App Store listing and are billed through Shopify. Your subscription is governed by the pricing shown at the time of purchase and by Shopify's billing terms. Taxes may apply.

4. Acceptable use

You agree not to misuse the Services, including by: (a) attempting to gain unauthorized access to the Services or related systems; (b) interfering with or disrupting the integrity or performance of the Services; (c) using the Services to violate any law or third-party right; or (d) reverse engineering or copying the Services except as permitted by law.

5. Your content and data

You retain all rights to your store data and theme files. You grant us the limited rights necessary to access and process that data solely to provide the Services (for example, to create backups and generate diffs). Our handling of personal information is described in our Privacy Policy.

6. Intellectual property

The Services, including all software, text, and design (excluding your content and third-party materials), are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms.

7. Third-party services

The Services rely on third parties, including Shopify and Google. We are not responsible for third-party services, and your use of them is governed by their respective terms and policies.

8. Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that backups will be complete or recoverable in all circumstances. You are responsible for maintaining your own independent backups.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your use of the Services or your violation of these Terms.

11. Termination

You may stop using the Services and uninstall the app at any time. We may suspend or terminate access to the Services if you violate these Terms or if necessary to protect the Services or other users.

12. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Georgia for any dispute that is not subject to arbitration or small-claims resolution.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest version, and your continued use of the Services after changes take effect constitutes acceptance.
